Former Attorney General of Louisiana, Charles C. Foti, Jr., Esq. a
partner at the law firm of Kahn Swick & Foti, LLC ("KSF") announces that
KSF has commenced an investigation into IPC The Hospitalist Company,
Inc. (Nasdaq: IPCM).
On December 9, 2013, the U.S. Department of Justice announced that the
government had intervened in a lawsuit against IPC that alleges that IPC
submitted false claims to federal health care programs. The false claims
lawsuit alleges that IPC physicians regularly engaged in "upcoding," in
which IPC sought payment for higher and more expensive levels of medical
service than were actually performed. Moreover, IPC allegedly encouraged
its physicians to bill at the highest levels regardless of the level of
service provided, trained physicians to use higher level codes and
encouraged physicians with lower billing levelsto "catch up" to their
peers. The government indicated to the court that it intends to file its
own complaint in the lawsuit.
KSF's investigation is focusing on whether IPC's officers and/or
directors breached their fiduciary duties to IPC's shareholders or
otherwise violated state or federal laws.
